Financial Market Law and Regulation

Course content

Financial Markets Law and Regulation matters to us all. It is about our payments, mortgages, banking, other forms of savings and pensions.  It is also about Norway’s sovereign wealth fund, the shares and bank-loans to business and the financial system. How should the law protect depositors and investors? How can regulation promote the stability of financial markets to avoid another financial crash? How to balance efficiency and competition with stability and the universal provision of banking services?

Learning outcome

The following reading list is common for the courses taught at bachelor’s and master’s level. Note that there are different achievement requirements:

  • Master’s level (10 credits): A good understanding is required
  • Bachelor’s level (10 credits): A general understanding is required

Learning outcome for master’s level (10 credits):

Knowledge

The course will provide a detailed introduction to:

  • Rules on the organization and business of institutions authorised to conduct banking, insurance and investment services
  • The rules of conduct of business for providers of financial services 
  • Prudential supervision of financial institutions and providers in the financial markets
  • Private law and the activities of licensed institutions

Skills

The candidate will be able to:

  • Identify legal issues of financial market regulation
  • Search, analyze and assemble legal sources in the area with a view to resolve legal questions
  • Apply financial market rules in interaction with general corporate law and administrative Law 
  • Analyse and explain the relevant rules
  • Contribute to the drafting of legal texts, such as statutes, regulations or contractual agreements

General competence

Candidates will be able to apply their knowledge and skills in:

  • Administrative proceedings in public and decision-making in private institutions
  • Judicial or ADR activities
  • Provision of legal advice
  • Legal Research
  • Statutory drafting and other regulatory work

Learning outcome for bachelor’s level (10 credits):

Knowledge

The course will provide an introduction to the principles of:

  • The rules of conduct of business
  • Prudential supervision of financial institutions
  • Private law and the activities of licensed institutions

Skills

The candidate will acquire a relevant background for:

  • Understanding financial market regulation
  • Using legal sources in the field

General competence

Candidates will acquire some basic knowledge of administrative proceedings in supervisory bodies and decision-making in private institutions and in alternative dispute resolution (ADR).The BA course will provide an introduction to the principles.  Compared to the MA course on the same topic, the reading is less and focus is on an introduction to the general principles. This will be reflected in the exam paper.
